Terms and Conditions

CONTRACT CONDITIONS
1. In this agreement the following expressions bear the following meanings:
"Booking Confirmation" describes the booking contract. "The Performer" means the person or persons jointly and severally if more than one collectively described as such in the Booking Confirmation. "The Hirer" means the person or persons described as such in the Booking Confirmation. "KFE" means Krossfire Entertainment of PO Box 7011, Toowoomba Mail Centre Qld 4352. "The Performance" means the date or dates as set out in the Booking Confirmation and unless stated to the contrary where a series of dates is specified any reference to the date of the performance shall refer to the first of such dates so specified. "The Parties" means the Hirer and the Performer being the parties to this Agreement. Words referring to the singular number include the plural and vice versa. Words referring to the masculine, feminine or neuter gender include all or any of the other genders. Where the Performer is a band or group comprising more than one person the term "Performer" shall mean the several members of that band or group.
2. The Hirer engages the Performer to appear, perform, and otherwise comply with the reasonable requests of the Hirer with respect to the appearance as specified in the Booking Confirmation.
3. The Hirer shall pay the fees in the amount and by the method as specified in the Booking Confirmation.
4. The Hirer acknowledges that the performer has orally informed KFE to confirm the performance on his behalf.
5. The Hirer and Performer acknowledge that KFE is not a party to this Agreement and is not responsible or liable in any way for the parties various obligations and liabilities including but not limited to public liability or workers compensation claims by any party whatsoever, or for any loss or damage caused by any act or default of either party.
6. The Hirer shall provide the Performer with proper dressing room facilities.
7. The Hirer must obtain all licences and consents from all relevant authorities for the performance and comply with all terms and conditions imposed in connection with any such licences or consents.
8. The Hirer shall provide at their cost, equipment access to the venue as specified in the Booking Confirmation and adequate time and access to the venue for the Performer to remove their equipment.
9. The Hirer shall provide for the proper security and safety of the Performer and the Performer's equipment and shall provide a safe properly constructed and sheltered area for each performance.
10. The Hirer shall provide safe and adequate power supplies for the performance.
11. Where any equipment including but not limited to public address systems, lighting, amplifiers or instruments are provided by the Hirer, the same shall be of proper quality and in good working order.
12. The Hirer agrees not to make or permit others to make any recording during the performance except with prior written approval from the Performer.
13. The Performer and Hirer agree that all repeat bookings, referrals and future work developed from this agreement are to be referred through KFE.
14. The Hirer may terminate this agreement by delivery of written notice to KFE not later than twenty eight days before the date of the performance whereupon this agreement shall be terminated and the Hirer shall forfeit his deposit including the booking fee. In the event of the Hirer failing to terminate this agreement as aforesaid it shall remain in force and the Performer shall be entitled to his fee and KFE shall be entitled to their fee as specified in the Booking Confirmation.
15. The Performer may terminate this agreement by delivery of written notice to the Hirer and KFE not later than twenty eight days before the date of the performance whereupon this agreement shall be terminated and the deposit including the booking fee shall be refunded to the Hirer provided always that the Performer may terminate this agreement at any time prior to the performance for reasons of sickness, emergency or national strike without penalty or prejudice in which case the deposit shall be refunded to the Hirer and neither party shall in any way further be liable to the other for any cost, expense or charge arising out of or incidental to this agreement.
16. This agreement shall be governed by the laws of the State of Queensland and the parties agree Queensland courts shall have jurisdiction hereover.
17. It is agreed and declared that any person signing for or on behalf of the Hirer warrants his authority to do so and accepts personal responsibility and liability for the payment of all monies and the due observance by the Hirer of all terms and obligations on the part of the Hirer.
18. Please note that non return of this agreement does not constitute cancellation or non acceptance of the conditions contained herein.
